Aupe Collective Agreement Ahs


AUPE remains active in the labour and provincial movement in Alberta. In the fall of 2007, she ran a major campaign to lobby for changes to Alberta`s labour laws that prohibit strikes by most AUPE members. Despite these prohibitions, AUPE members have repeatedly engaged in illegal strikes to speed up their collective agreement claims. First, the Tribunal found that the arbitrator had indeed misappropriated the subjective intentions of the parties by identifying a point of overlap (both parties intended to include at least the OBP program) and considered this point of overlap to be an objective meaning of “operational restructuring”. This would be contrary to the principle, confirmed in Sattva, that extrinsic evidence cannot repeal the text of the agreement. As a first point, the court found that the work-conciliatory jurisprudence, which is that an arbitrator must first find that a collective agreement is ambiguous before considering the extrinsic evidence is no longer applicable in the light of Sattva. On the contrary, the arbitrator of Sattva`s work must consider the evidence of the circumstances relevant to the interpretation of a collective agreement, whether the agreement is ambiguous or not. The Tribunal was not concerned with the Adjudicator`s finding that the LOU was ambiguous on the facts of the case in this case, since the terms “operational restructuring” were reasonably capable of more than one interpretation. Between 1997 and 2006, the AUPE was rebuilt. While membership continued to decline in the early years of the decade, the framework conditions were finally reversed. A booming economy, facing a labour shortage, has improved the climate of organization and negotiation. AUPE has folded its collective muscles into illegal but effective work operations and has begun to gather an unprecedented number of new members through mergers and organization. AUPE originated in the Alberta Civil Service Association, founded in 1919 to represent “civilian bailiffs,” as the direct employees of the Alberta government were then called.
